White House Hosts Crypto and Prediction Market Summit as CFTC Invokes Emergency Authority, August 2026

Crypto exchanges and digital asset intermediaries tracking the SEC's Regulation Crypto rulemaking should note that the postponement does not resolve the threshold question of which digital assets are securities and which are commodities. No federal court has yet issued a ruling on whether state regulators may enjoin a CFTC-designated contract market from operating prediction market event contracts. The CFTC's decision to invoke emergency authority rather than allow the exchange to suspend operations suggests the Commission views continuous operation of designated contract markets as a core principle under CEA Section 5(d). The outcome of any federal court proceedings on the New York restraining order application will set precedent on the federal preemption question for the prediction market sector.
