White House Issues Executive Order 14409 Promoting Advanced AI Innovation and Security, 2 June 2026

The Order directs executive agencies to prioritize cyber defense of National Security Systems, Department of War information systems, and civilian federal infrastructure, and to protect US AI intellectual property from foreign adversary theft. EO 14409 derives authority from the President's constitutional role as Commander in Chief and chief executive. Its directives require appropriate agencies to prioritize cyber defense of National Security Systems and Department of War information systems. Agencies must harden civilian federal government information systems against external threats, protect US AI intellectual property from exploitation and theft by foreign adversaries, and cultivate advanced AI-enabled national security capabilities. The Order operates alongside National Security Presidential Memorandum NSPM-11, signed the same week, which separately addresses AI in the national security enterprise.

Federal contractors, cloud service providers, and technology companies with US government contracts will face implementing requirements as agencies translate EO 14409 into security standards and procurement specifications. AI developers whose systems serve national security or defense clients should prepare for enhanced supply chain reviews, model provenance documentation, and stricter data handling requirements. The intellectual property protection directive signals closer executive branch scrutiny of foreign investment in and acquisition of US AI companies and research outputs.

Agency-specific compliance timelines and security standards will emerge from forthcoming procurement policy updates and rulemaking rather than from the Order itself. EO 14409 operates in parallel with existing Committee on Foreign Investment in the United States review of AI-related transactions and with CHIPS and Science Act research security requirements. No grandfather provisions or transition periods are specified in the Order.
