Poland's Act on Artificial Intelligence Systems Enters Into Force, 11 August 2026

The Act of 3 July 2026 on artificial intelligence systems was promulgated in Dziennik Ustaw 2026 item 1003 on 27 July 2026 and entered into force on 11 August 2026. It designates the Commission for the Development and Security of Artificial Intelligence as Poland's market surveillance authority under Regulation (EU) 2024/1689. Articles 8 to 18 and Chapters 3 to 5, 8 and 9 apply from 28 October 2026, setting the date on which the supervisory and penalty provisions begin to operate.

Poland has enacted national implementing legislation for Regulation (EU) 2024/1689. The Act of 3 July 2026 on artificial intelligence systems (ustawa o systemach sztucznej inteligencji) was promulgated in the Polish Journal of Laws, Dziennik Ustaw of 2026 under item 1003, published on 27 July 2026. The Act entered into force on 11 August 2026 and carries a staged commencement: Article 125(4) applied from 28 July 2026, while Articles 8 to 18 and Chapters 3 to 5, 8 and 9 apply from 28 October 2026.

The Act gives domestic effect to Regulation (EU) 2024/1689 laying down harmonised rules on artificial intelligence. Article 5(1) designates the Commission for the Development and Security of Artificial Intelligence, the Komisja Rozwoju i Bezpieczenstwa Sztucznej Inteligencji, as the market surveillance authority for artificial intelligence systems. Article 1(5) brings the rules on imposing administrative monetary penalties within the scope of the Act. The minister responsible for informatisation is the competent ministry. The Act is recorded as relating also to Regulation (EU) 2022/2065 and Regulation (EU) 2016/679.

Providers and deployers placing artificial intelligence systems on the Polish market now answer to a named domestic regulator rather than to the Regulation alone. Companies running recruitment scoring, credit decisioning, biometric identification or clinical triage systems in Poland should establish which of those systems fall inside the high-risk categories of Regulation (EU) 2024/1689 before 28 October 2026, when the supervisory and penalty chapters take effect. Providers established outside Poland that sell into the market through importers or distributors are covered on the same terms as domestic ones.

The staged commencement creates an interval. Between 11 August and 28 October 2026 the Act is in force, but the chapters carrying the procedure before the market surveillance authority and the penalty provisions are not yet operative. Firms that use those weeks to complete artificial intelligence system inventories, conformity documentation and deployer instructions will meet 28 October 2026 in a stronger position than those waiting for the first supervisory decisions.
