ESMA has published new Q&As on October 16, 2026, regarding the use of payment accounts by Crypto-Asset Service Providers (CASPs) for holding clients' funds. The guidance clarifies regulatory expectations for CASPs about accepting funds from non-bank payment service providers.
The new Q&As are part of the MiCA regime and specifically address the use of payment accounts by CASPs, as outlined in document number 2949.
The guidance applies to Crypto-Asset Service Providers (CASPs) that manage client assets and accept funds from non-bank payment service providers.
ESMA has also finalized its review of guidelines under the Market Abuse Regulation (MAR) on the delay in the disclosure of inside information, which aims to streamline the disclosure process for issuers.
The updated MAR guidelines assist issuers in deciding when to delay disclosure, identifying five additional legitimate interests for such delays. Issuers are no longer required to disclose inside information related to protracted processes before their completion since June 2026.
