On 30 July 2026, the Federal Financial Supervisory Authority (Bafin) imposed an administrative fine of €15,000 on Effecta GmbH for breaching supervisory duties related to Article 13(1) and Article 14 of Regulation (EU) No 1286/2014 (PRIIPs Regulation). Effecta GmbH offered a profit participation certificate to retail investors without publishing a key information document beforehand.
Bafin also imposed an administrative fine of €9,000 on Companisto Trust Service XXXV UG on the same date for violating Article 5(1) of Regulation (EU) No 1286/2014 (PRIIPs Regulation). Companisto Trust Service XXXV UG acted as a PRIIP manufacturer and offered the same profit participation certificate to retail investors without the required key information document.
These fines apply to Effecta GmbH and Companisto Trust Service XXXV UG, both of which failed to comply with the PRIIPs Regulation regarding the publication of key information documents before marketing investment products to retail investors.
