The AMF issued a reminder on 5 February 2026 regarding the transitional period for Digital Asset Service Providers (DASPs). This period allows DASPs to continue providing crypto-asset services in France without MiCA authorization until 1 July 2026.
The reminder cites Article 143 of the Markets in Crypto-Assets (MiCA) Regulation and Article 8 III of the DDADUE Law of 9 March 2023. DASPs engaged in crypto-asset services before MiCA's entry into force must obtain authorization as Crypto-Asset Service Providers (CASPs) under MiCA by the deadline.
The reminder applies to DASPs registered or licensed in France. They must submit their MiCA authorization applications as soon as possible to avoid disruptions in their operations.
DASPs that do not intend to continue their activities must implement an orderly cessation of business by 30 March 2026. Providers not authorized as CASPs must cease operations by 1 July 2026, or face penalties including a two-year prison sentence and a €30,000 fine.
The AMF emphasizes the importance of submitting complete application files to avoid delays in the authorization process. The review period for CASP authorization may take up to four months once a complete file is submitted.
