The AMF has finalized updates to its in-depth section on the Markets in Crypto-Assets (MiCA) regulation as of 29 November 2024. The document outlines the obligations for crypto-asset service providers (CASPs), including application procedures for authorization and notification of public offers.
The MiCA regulation, as detailed in the updated guidelines, applies to natural and legal persons engaged in the issuance, offer to the public, and admission to trading of crypto-assets within the European Union. CASPs must adhere to the regulatory and implementing technical standards set forth in the MiCA regulation.
All CASPs currently operating under national transitional regimes must submit their full MiCA authorization applications by 1 July 2026. Failure to do so will result in the loss of their right to operate in the EU.
The updated guidelines emphasize the need for compliance officers to review existing practices against the new requirements and prepare for the upcoming regulatory changes. This includes ensuring that necessary applications are submitted before the stated deadline.
