Detailed overview

Mauritius does not currently have a fully enacted AI Act, but it has adopted a national AI strategy and official AI governance guidelines. The Cabinet agreed to adopt the Artificial Intelligence Strategy, "AI for Mauritius," as the national guiding policy framework for AI development and implementation.

The national strategy is supported by FAIR Guidelines, meaning Fair, Accountable, Inclusive and Responsible AI. These guidelines provide practical direction for responsible AI adoption, development and use across sectors, taking into account Mauritian realities while aligning with international practice. Official Cabinet materials state that the guidelines are expected to evolve into AI regulations as the ecosystem matures.

Mauritius has also addressed generative AI in government. The Data Protection Office, in collaboration with the Ministry of Information Technology, Communication and Innovation, has issued a Generative AI Policy for public officers. The policy is intended to ensure responsible, secure and lawful use of generative AI tools in government operations and applies to public officers, contractors and third parties dealing with public authorities.

The wider national data strategy refers to preparation of an AI Guide and establishment of an AI Unit under the Ministry of IT to integrate AI across national digital projects. It also refers to AI-powered digital public services, including agentic AI, multimodal large language models and retrieval-augmented generation for public-service delivery.

Mauritius does not currently have one AI-specific penalty table. Penalties depend on the underlying law breached, including data protection, cybersecurity, consumer protection, financial regulation, healthcare regulation, employment law, public-sector rules, civil liability or criminal law.
